On The Supervision Of The National Commission Of Supervision

On December 26,2016,the 25 th meeting of the Standing Committee of the Twelfth National People's Congress adopted the "Decision of the Standing Committee of the National People's Congress on Pilot Reform of National Monitoring System in Beijing,Shanxi and Zhejiang Provinces" Since then,a new state-level inspection department has been established.Compared with other inspection agencies such as discipline inspection and supervision agencies,the inspection commission has a higher and larger administrative scope and supervision and has the power to impose coercive measures.Any use of power should be supervised.As an important part of administrative power,supervisory power,once abused,will undermine the rights and interests of the supervised and thus affect the implementation of the strategy of governing the country by law.This article tries to analyze the problems of the state supervisory system through the research on the supervisory system of China and other countries and the foreign practice of restricting the exercise of the supervisory power.It explores how to control the supervisory power rationally so as to safeguard the supervisor's rights and maintain social harmony and stability.Restrict the exercise of the powers of supervision,put forward suggestions and countermeasures,and provide reference and reference for the establishment and revision of relevant laws and regulations.
