Research Of Qualifications Recognition Mechanism Under The Movement Of Natural Persons

With the further development of the world economy,international trade in services accounts for an increasing proportion of international trade,especially in some developed countries,having the trend to transcend the international trade in goods,but compared to the relatively mature rules of international trades in goods,international trade in services is facing greater obstacles,the qualifications recognition mechanism under the movement of natural persons is one of them.Although the GATS and various regional trade agreements and bilateral trade agreements involves the qualifications recognition under the movement of natural persons,the design flaws of relevant qualifications recognition mechanism,including the subjects of recognition,applicable objects,content and standards,procedures,disputes settlement,etc.the qualifications recognition mechanism under the movement of natural persons is still a huge obstacle for the international trade in services.Therefore,it is necessary to find out the crux of the existing mechanism of qualifications recognition,then propose some feasible suggestions,try to eliminate the obstacles in qualifications recognition of the service providers,and gradually realize the convenience of qualifications recognition,so as to promote the development of international trade in services,and make some suggestions to qualifications recognition mechanism under the movement of natural persons of multilateral trade agreements,such as GATS and TISA,regional trade agreements,such as RCEP and bilateral trade agreements,the construction of "one belt,one road".In addition to the reference and postscript,this paper is divided into five parts.Respectively:The first part is the introduction.This paper summarizes the reasons that I choose the qualifications recognition mechanism under the movement of natural persons as the selected topic,and the significance of researching on this topic,the current research status at home and abroad,research methods,innovations and shortages.The second part is an overview of the qualifications recognition mechanism under the movement of natural persons.In this part,firstly,I introduce the basic contents of the qualifications recognition mechanism under the movement of natural persons,and discuss the concept,scope,classification of qualifications recognition under the movement of natural persons,define and classify them.Secondly,I further summarize the ever-improving development process of the qualifications recognition mechanism under the movement of natural persons from the sprout of the Middle Ages to the present.The third part is the concrete practice of the qualification mechanism under the movement of natural persons.This part mainly summarizes the relevant concrete practice of the EU,ASEAN,Australia and New Zealand on the qualifications recognition under the movement of natural persons,and divides them into subjects of recognition,applicable objects,content and standards,procedures,compensation measures and new technologies,disputes settlement.The fourth part is the existing problems of the qualifications mechanism of natural persons.Analyzing the existing problems in subjects of recognition,applicable objects,content and standards,the procedures of recognition,disputes settlement clearly,and then summaries it.The fifth part is the perfecting suggestions of the qualifications recognition mechanism under the movement of natural persons.On account of the problems arose from the fourth part,drawing lessons form the established high-level qualifications recognition under the movement of natural persons and making some improvement.Firstly,I put forward the perfecting paths and the principles,and then put forward some suggestions on how to improve.The sixth part is the conclusion.Even the EU's market is highly unified,its qualifications recognition mechanism under the movement of natural persons still has many shortcomings.The elimination of barriers to the qualifications recognition mechanism under the movement of natural persons in a global scale is not a treaty or an agreement can solve.Only many countries,regions and international organizations work together and through a long period of time can make it.
