Study On Local Specialties Of Local Legislation

As an important part of the Socialist Legal System with Chinese Characteristics,Local legislation plays an important role in ensuring the implementation of laws in local places,supplementing national legislation and local conditions to solve local problems independently.The newly revised Legislation Law of the People's Republic of China(hereinafter referred to as the "Legislative Law")in 2015 expands the scope of the main body of local legislative power and gives municipal and local municipal laws and regulations and local government rules and regulations the power to establish the district.All cities divided into districts can provide legal protection for the development of local economy,society and other areas through legislation.Since the revision of the Legislative Law,the number of local regulations has risen sharply in the past two years,so the cities divided into districts should have more control over the quality of the established laws and regulations.The author chooses the local specialties of local legislation as the point of entry.and chooses the local laws and regulations in the 16 cities divided into districts in Anhui Province after the amendment of the legislation law,through the analysis of local characteristic theory and the empirical analysis on the local legislation of the 16 cities divided into districts in Anhui Province to find the achievements and shortcomings of local characteristics on local legislation.Finally,I will draw the conclusion to all the cities divided into districts and put forward the proposal on how to improve the local characteristics of local legislation.The first part of this article is mainly about the theoretical exploration of the local characteristics of local legislation.The substantial theoretical analysis is a prerequisite and foundation for the empirical analysis of the legislation of the cities in Anhui Province.Only through a thorough understanding of the theoretical features of local legislation can we better analyze the problems existing in the practice of local legislation in Anhui Province and the direction for future improvements.Therefore,the author here defines the concept of local characteristics and sorts out the process of establishing the principle of legislation,so that the following can better analyze the legislative practice.The second part is the empirical analysis of the legislative achievements made after the amendment of the legislation law of the cities in anhui province.After the city divided into districts with legislative power have mounted a number of local laws and regulations,such laws and regulations can be able to project from system design and legislation aspects reflect the local characteristics of anhui province,the choice of whether to national legislation played a supplementary role,and there is a copy phenomenon between different districts of the city is a focus in the study of this part.The last part mainly discusses how to enhance the local characteristics of local legislation.Cities divided into districts in the future legislation should fully realize the importance of local characteristics,to develop a more realistic legislation project,enhance the maneuverability of relevant local legislation system,adhere to the problem of local legislation orientation,improve the level of a contingent of professional legislation and strengthen the supervision of local legislation method to strengthen the legislation in place characteristic,improving the local lawmaking quality,will place really become an important tool to promote the development of local legislation,also provide certain reference for the legislation of national level.
