The With the acceleration of the pace of scientific legislation and democratic legislation in our country,the frequency of third party participation in legislation has become higher and higher.As an important part of the public participation in legislation,the participation of third parties in the development of legislation has deeply laid the mark of Chinese-style democracy.Both the source of rights and the theoretical basis for research have embodied the inner legitimacy of the democratic legislation under the unified system of socialist countries.Features and development characteristics.Judging from the practice of scientific legislation,the three issues of sectoral interest-led legislation,the need for scientific improvement,and the fact that legislation seriously lags behind the practice have not been properly resolved.In recent years,especially during the Third Plenary Session of the 18th CPC Central Committee,the process of scientific and democratic legislation has been speeding up,and new ways of participating in legislation such as entrusting legislation and third-party assessment have gradually entered the vision of the central decision-making.From the perspective of public participation in legislation,this paper summarizes the theoretical basis for the participation of third parties in legislation,and shows that third party participation in legislation reflects public interests and is a realistic expression of the will of citizens.On this basis,this article examines the actual and institutionalization of third-party participation in legislation,summarizes in detail the ways in which third parties participate in legislation in practice,and conducts in-depth studies of various approaches,thus revealing third-party participation in legislation.The difficulties faced and the breakthrough innovations that the practice has made to overcome the drawbacks of the traditional path.In general,third-party assessments and entrusting the drafting of draft legislation are new ways and for third parties to participate in legislation that have been developed in practice.They have overcome the problems caused by the traditional participatory approach to some extent,and have greatly promoted the standardization of legislative texts.,scientific.Since then,the realistic profile of third parties participating in legislation has become clear.Based on the practice of foreign third parties participating in legislation,the author proposes three key elements of constructing China's third party participation in the legislative system,namely,neutrality of third parties,construction of rule of law,and improvement of program design.
