Investigation On Democratic Legislation Of Harbin Municipal People 's Congress

Local legislation an important part of socialism legislation system in our country, our Constitution stipulates that all power belongs to the people. The people are the masters of the country, an important aspect of the people to be in power is through a variety of ways to participate in the national legislative activities, so that the laws and regulations can truly reflect the will of the people, and reflect the masses of the people’s fundamental interests and long-term interests. Standing Committee of Harbin People’s Congress has performed the local legislation power for nearly 30 years, and has always regarded the democratic legislation work as the starting point and the foothold of local legislation work. The Committee has been continuing to broaden the channel of the masses participation in local legislation, built a series of platform for people’s participation in local legislation, and formed a set of system. However, with the gradually increasing of people’s legal awareness, and enthusiasm of participation in local legislation, there’s a long way to go for members of the Standing Committee of the local people’s congresses, so as to further explore the democratic legislation, to safeguard the legal status of the people in Harbin,and to realize the maximization of their interests.This paper is divided into four parts, and the contents of each part are as follows:Part one, the practice exploration of Democratic Legislation of Standing Committee of Harbin People’s Congress. Harbin People’s Congress and its Standing Committee has established strict working procedure of extensive solicitation, layers of screening, repeated demonstration, and enacted 22 legislation plans. The number of seminars, demonstration conferences, including the forum held has increased year by year. The work of draft regulations to solicit opinions from the public has stepped into institutional ization, standardization and normalization. In February 2004, the 7th conference of the 12th Harbin National People’s Congress passed "regulations of the legislation hearing in Harbin".Part two, the characteristics and shortcomings of Harbin Municipal People’s Congress democratic legislation. The characteristics of the NPC and its standing committee democratic legislation work in Harbin are as follows, first, the main body of participation gradually expanded; second, the forms of participation are gradually rich; third, the contents are gradually comprehensive. But there are still some problems:first, the understanding remains be improved. Second, the department legislation is too strong. Third the democratic process is not perfect.Part three, suggestions on promoting and improving the NPC’s democracy legislation. Raise awareness; diversify proposal subject; publicize legislation information; improve legislation hearing; strengthen contact between members of the Standing Committee of NPC deputies and voters; learn from the legislative developed countries; learn experience from other provinces and cities.Part four, the eighteen sessions of fourth plenary session put forward that law is the foundation of a nation, and good law is the premise of good governance. Harbin local democratic legislation work is to make a fair and open principle running through the whole process of legislation, insist on legislating, amending, abolishing and explaining simultaneously, strengthen the timeliness, systematicness, pertinence and effectiveness. At the same time, improve the legislation system, legislation project collection and demonstration system, perfect ways of the legislature leading, social parties orderly participation, and broaden citizens’ways to orderly participate in legislation.
