With the rise of economic globalization and regional economic integration,the tradit ional public management model has been unable to provide effective institutional arrange ments for regional governance.Under this background,soft law has emerged as a new governance tool.In the administrative field,it mainly represents the normative document s of inter-government contracts,development plans,and intergovernmental cooperation.T his institutional arrangement makes up for the deficiencies of a single hard regulation sy stem in the transition from regional management to regional governance,and has strong flexibility.Responsiveness in reality has been widely used in the practice of regional go vernance in the Yangtze River Delta in China.Together with traditional hard law,it con stitutes a legal system for regional governance.The synergy between the two is related t o the effectiveness of regional governance.This study combines the relevant theories of institutional economics and synergies,and b elieves that the regional legal system is constantly evolving in an unordered and orderly state.Subsystems work together to achieve ordering in the functional,spatial,and temp oral dimensions through synergies.This study takes the Yangtze River Delta region as a n object,and studies the patterns that it has formed when it pursues the cooperation bet ween hard law and soft law.It is found that the current system coordination between ha rd law and soft law in the Yangtze River Delta region is still a low level.At the level of "order",the system coordination of legal systems in regional governance is a proces s of Pareto optimization.The institutional vacuum,institutional conflicts of hard law sub systems,and the low efficiency of the soft law subsystems are the predicaments present in the system coordination.And put forward the path of institutional coordination:to b uild a regional legislative coordination mechanism,supplemented by increasing the suppl y of regional hard law resources;try to give the legitimacy of the soft law system,and actively improve the construction of soft law related systems. |
