Trustworthiness Measurement Method Research Of Electronic Evidence On Operational Complexity Model

The trustworthiness of electronic evidence has attracted wide attention in the judiciary and academia.It is difficult to measure the trustworthiness of electronic evidence quickly and effectively,thus rendering the obtained evidence often be questioned.Lack effective method to measure the trustworthiness of electronic evidence in the stage of evidence analysis and presentation.How to help the forensic experts,lawyers,judges,etc determine and debate the feasibility of different defense reasons and the trustworthiness of electronic data quickly and effectively is a huge challenge of computer forensics.This thesis focuses on the following aspects to measure the trustworthiness of electronic evidence.First of all,this thesis summarizes the current research of the trustworthiness measurement method of electronic evidence.It mainly includes the concept and method of trustworthiness forensics,the process of the traditional static forensics and network forensics,and the influence of the anti-forensic technology on the trustworthiness of the obtained electronic evidence.Secondly,this thesis proposes a measurement method based on the operational complexity model to measure the probability of the data erase which will lead the electronic evidence untrustworthy.The method can be used to measure the impact of data erase on the trustworthiness of the obtained electronic evidence.It provides the reference value for the untrustworthy possibility of electronic evidence caused by the data erase in the traditional computer forensics.Finally,combined with the suspect motivation level,this thesis classifies the computer operation ability,considering the error of the capacity,calculates the possibility of the suspect can complete the relevant criminal operation or anti forensics operation,then proposes a capability and motivation driven trustworthiness measurement method on complexity operation model to measure the trustworthiness of electronic evidence.Then,this thesis applies the trustworthiness measurement method to the specific case,realizes the electronic evidence trustworthiness measurement tool,and calculates the trustworthy reference probability of the obtained electronic evidence,provides a reference of the trustworthiness of electronic evidence for the forensic staff,lawyers and judges.
