With the rapid development of Chinese society over the past forty years,the socialist legal system with Chinese characteristics has been growing gradually.In the legal norms of the doctor-patient relationship,however,there is inequality between the relationship,namely,a biased protection for the so-called weak patient.In addition,the increasing medical disputes in practice and the expansion of ‘medical trouble' have drawn the attention of the public in terms of the rights and interests of the patients.And the legitimate rights and interests of medical staff cannot be guaranteed as their work environment gets worse.The doctor-patient relationship is not a simple commodity transaction but interdependence and coexistence.Therefore,not only does that the rights and interests of medical staff are improved contribute to ensuring their development to form a harmonious relationship between doctors and patients,but also promote the growth of medical and health care in China and improve the health level of the whole nation.Concerning above the benefits,the discussion of the legal rights and interests of medical staff in China is to call on the protection for those who have been ignored for a long time,and to build better doctor-patient relationship and reduce medical disputes as a perfect way.In this regard,the thesis intends to conduct an analysis from the following aspects.The first part is about the discussion of the status quo of the protection of medical staff's legal rights and interests in medical disputes.In the conclusion,we have summed up characteristics in the protection of medical staff's legal rights and interests.All these characteristics lay a realistic foundation for further analysis.The second part is exactly the further analysis of the current situation of the medical staff's legal rights and interests in the medical disputes mentioned above.In this part,we are going to point out the existing problems at present,and carry out a more specific analysis from the four aspects to conclude the crux of these problems.The third part mainly focuses on the reflection and countermeasures on the protection of medical staff's legal rights and interests in medical disputes.Based on the previous practice and the root cause,we will put forward specific suggestions on how to defend the legal rights and interests of medical staff in medical disputes,hoping provide reference on the way to enhance theprotection.
