On The Protection Of The Rights And Interests Of The Lost Of The Only Child Family

The lost of the only child family have become an increasingly serious social problem and have begun to attract national and social concerns.In the late 1970s,many families had only one child in response to the country's family planning policy.But now there is a part of family' s child death before their parents,and then their family became the lost of the only child family.The lost of the only child family must face many problems such as pension problems,economic and legal aid difficulties,and there is few of national remedies and government intervention.This article elaborated the theory of protecting the rights of the lost of the only child by the basic human rights theory and the rights and obligations in the legal theory.The lost of the only child family in China face so many problems,but China's current legal system and pension system are still not sound.The experiences on many Western countries to save these problems are worth to learn.In this article,there is a great reference value to set up the protection systems of the lost of the only child family by introduction of the Japanese adult guardianship system,the American legal aid system,German pension insurance system.Finally,to save these problems the nation can build the stereoscopic protection system by improve the basis of legal protection,clear the government' s implementing agencies and function,establish the legal aid system and adult guardianship system of the lost of the only child family.
