Research On Disciplinary Punishment System Of College Students From The Perspective Of Government By Law

“The decree is the rule of the country.” As an important method of social governance,the rule of law is a solid guarantee for the development of the country and the orderly operation of social life.It is the realization of restraining public power,balancing social interests,regulating social behavior,and adjusting society.An important grip on relationships.General Secretary Xi Jinping pointed out in the report of the Nineteenth Congress that we must fully adhere to the rule of law.Managing the country according to law is an essential requirement and an important guarantee for socialism with Chinese characteristics.First,the legal relationship between universities and students and the nature of school disposition.In view of the fact that the management rights of college students belong to a kind of public power which cannot exclude the influence of the state,the legal relationship between colleges and students must have two kinds: civil civil relations and administrative legal relations.However,with the development of society,between universities and students The legal relationship is no longer a single legal relationship.Therefore,from the nature of the disposition right of colleges and universities,the types of legal relationships between students and colleges and universities can be specifically identified,so as to find a solution.Second,the problems existing in the disciplinary system of the institutions of higher education in the youth in the country.This article makes empirical and theoretical analysis of the disciplinary system of the students in the universities in China.Through analysis,it is believed that there is still room for resident colleges in Qinghai to have a hearing system,protection of student rights,improvement of punishment procedures,publicity of complaints system,protection of privacy,and follow-up education.From the table and the inside,we analyze the common problemsexisting in the institutional construction,system implementation,and post-event relief of Chinese universities.Third,the reasons for the disciplinary sanctions system.The main reasons are that some colleges and universities are lacking in the concept of "people-oriented" thinking,the lack of legal thinking in the staff,and the tendency of "instrumentalization" in the purpose of punishment.Fourth,how to establish a disciplinary system for students in institutions of higher learning that is in line with the principles of the rule of law under the criteria of comprehensively governing the country according to law.From the three aspects of scientific legislation,strict law enforcement and law-abiding by the whole people,we should establish rules and regulations for students' disciplinary disciplines in line with the principles of the rule of law,and improve students' legal rights and interests.
