Anhui Farmland Protection Issues And Research Of Clarifying Responsibilities

Plough is the basis of survival of human beings.Keeping the plough relatively stable in amount and quality is of great importance to guarantee the food security.Protecting the plough means protecting ourselves.But,recently,with the development of urbanization and the expansion of all walks,the demand of plough is increasing which is inevitablly harmful for the plough. On this occasion,the central government suggests protecting the plough over and over again and carries out the most strict system of plough protection.On account of the deficiencies of plough protection in system,Anhui province games the central government for self-interest.The farmers in Anhui is lake of enthusiasm of plough protection.Also the citizens and the main food sale area in Anhui and its counties do nothing to protect the plough. Although the situation of rapid decline of plough has been improved,some problem still remain.According to the foreign experience,it is not contradictory between urbanization and plough protection.It is very important to design a good systmen of plough protection which can protect the plough at its most fundamental.On the basis of the predecessors,this paper satses the situation of plough protection and make sure of the behavior subjects of plough protection firstly with the method of economics,management science,the science of law and so on.Then clarifies the rights and responsibilities of farmers,citizens,the units using the land,major grain-producing areas,the main food sale area and other relevant subjects in Anhui and its counties with the methods of incentive and restraint theory,the rights and obligations equivalent analysis and so on.Finally,according to active actions,act but not active and omission,clarifies the rights and reponsibilities as follows.The subject of active actions is the central government.It owns and governs the state-owned land,designs the relevant policies of plough protection,deals with the contradictories between the polities of plough protection and other polities,supervises the local government in protecting plough,stimulates the farmers,rural collective.the units using the land and major grain-producing areas to protect the plough and make sure of the responsibilities of citizens and the main food sale area in Anhui and its counties falling into its place.Inactively bodies include:Anhui Province, local government-owned land acquisition and agricultural land into non-agricultural land part of the approval authority, with new construction land use fee rights; responsible for the implementation of central government policies farmland protection, monitoring and inspired by a department farmland protection behavior, manage and motivate the farmers, the village collective unit of arable land protection behavior. Angus farmers have the right to contract land or state land use and land collectively owned by peasants; responsible for maintaining the agricultural use of the land, the land legally responsible for the protection, conservation and intensive use of land. Annie rural collective ownership of rural collective land ownership and use; responsible for implementing the Farmland Protection Policy higher levels of government departments, monitoring the behavior of Anhui farmers to protect farmland and revitalize the stock of land development, land consolidation and improvement, promote conservation and intensive land use, promote the protection of arable new technologies, construction of water conservancy facilities and an increase in land investment. Angus Province has made arable land for non-agricultural units use rights according to law; has accounted for much of arable land, make much arable land, accounting for quality farmland, make high-quality arable land, rational development, inventory control, intensive land conservation protection, management and rational use of land obligations. As China's major grain producing areas in Anhui Province has the right to obtain the corresponding national compensation, has the obligation to produce food for the country and the protection of arable land.Useless bodies include:Anhui City citizens who have the right to produce food but not directly enjoy the national food security; who has the responsibility to protect the interests of arable land and be compensated for the direct grain producers. Food sales areas neighboring Anhui Province have the right not to produce food or to produce food but rarely enjoy the national food security; the citizens who obligation to protect farmland and provide benefits for the sales areas of compensation.This paper clarifies the rights and obligations of these subjects, for the situation of "subject" and "non-subject" of these subjects for farmland protection, reasonable recommendations could be offered, in order to facilitate the establishing of farmland protection policy and the protection of all participants. What's more, it is also practical and essential to stabilize the scale of arable land, improving the quality of farmland, as well as to ensure our food security.
