The Development Of China's Industry Association And Self- Regulation Mechanism Research

Industry Association is a branch of non-profit social organizations, as an important part of civil society in the field and market field, it is inseparable, is closely connected with economic activities. At the same time, the industry association is different from other non-profit organizations, in accordance with the “state- Society – market” pattern, industry association as the market intermediary organization, play an important role as a bridge and link between the government and enterprises.Based on the condition of socialist market economy in our country, industry association also plays the key role in the transformation of government functions and resolving trade disputes, etc. The current law of our country to define the legal status of industry association and the related rules and regulations are not perfect. Firstly, the industry association should abide by the constitution, and then engage in business but not damage the country and public interests. Secondly, the government would like to provide a relatively free environment to the industry association, and let it do business according to the articles of association and related laws and regulations. Meanwhile, any other organization or individual cannot illegally interfere. Nevertheless, there always is institutional deficiency accompanying with government regulation, which must be fixed by industry self-regulation. Industry self-regulation mechanism can reduce the cost of law enforcement, and provide support for the effective operation of the law as well as nip in the bud.This dissertation consists of six parts. The first chapter introduces the background, significance of this research, research methods and innovative points. The second chapter introduces the basic theory of industry associations, including the related concepts; the essential features, the classification and the function, as well as compare with other types of community organization. The third chapter introduces the development process of China's industry association. The forth chapter analyzes the legal status of our country's industry association. In addition to the study of industry association in the current legal system, it also includes the investigation on the status of industry associations in the actual social economic life, and then put forward the importance of industry association's self-regulation mechanism. The fifth chapter is to introduce an overview of China's security product industry association, to analyze its existing self-regulation mechanisms, and make recommendations on how to promote self-regulation of security product industry association. The sixth chapter points out that based on the case study of security product industry association's self-regulation mechanism, the conclusion is that it is not enough to provide the self-regulation mechanism mode for all industry associations, but it is desirable that through summarizing the self-regulation mechanism of Security Product Industry Association, it reveals related specific requirements.
