At present, China's auto industry exists serious phenomenon of monopoly, administrative monopoly and economic monopoly.Administrative monopoly to break the laws of supply and demand market, directly disrupt the normal order competition, competition mechanism to play its proper role, thus damaging the auto industry in our country.Economic monopoly of the auto industry, however, will limit car industry healthy and orderly development, affect the automotive aftermarket, raise the automotive after-sales and spare parts price, damage the interests of consumers.In addition, the current problems of Chinese antitrust legislation level, hampering antitrust work in automotive industry.The anti-monopoly law promulgated since 2008, has been implemented for more than eight years, but the effect and expected gap, and then introduced the measures for the implementation of "automobile brand sales management are in conflict with the anti-monopoly law, some of these rules directly contrary to the anti-monopoly law spirit, therefore, auto industry lacks the clear legal guidelines.Moreover, China's auto industry antitrust is difficult due to lack of the relevant practical experience.The European Union and the United States competition law system not only mature and rich practical experience, successful experience by countries around the world to learn from.By analyzing the development of China's auto market monopoly situation and the existing problems and summary of the European Union and the United States in the automotive industry in the process of antitrust legislation and law enforcement experience, to explore China's auto industry antitrust legislation and law enforcement problems, and puts forward related Suggestions.
