The Study Of China's Agricultural Trade Protection Based On Anti-dumping Measures

with the gradual opening of China's agricultural products and the increasing agricultural trade since the accession to the World Trade Organization, it has made important contributions to the adjustment of agriculture production structure and the rising demands. However, the widening price gap between the domestic market and abroad poses a huge challenge for the farmers' income and the development of the agriculture. Due to agricultural trade protectionism, many countries make a series of protection measures among which anti-dumping is one of effective way reducing the negative impact for the dumping of imported commodities. According to the WTO anti-dumping Agreement,the importers have over two-years inquiry since initiating a anti-dumping lawsuit,which save the buffer time for adjusting agricultural structure and boosting competitiveness. In this case,It is a pressing problem for Chinese government to apply anti-dumping measures into practice so as to protect domestic industries and promote the fair competition under the circumstances of expanding trade deficit. This paper uses the method of anti-dumping theory which based on current anti-dumping situation of agriculture products, then discuss the dumping products potato starch and soybeans in China. The conclusions are as follows:(1) As the enforcement of antidumping measures, Chinese agriculture products have been suffered repeatedly by anti-dumping charges. In comparison with other countries,the application of anti-dumping are still not mature enough in China.(2) This paper studies the one of the dumping products- imported soybeans, it founds the imported U. S. soybeans export to China in a low price with the advantage of farm subsidies which cause harm to domestic industry. In consequence, The imported U. S. soybeans is predatory dumping, the government should attach importance to it.(3) This paper discusses the first agriculture anti-dumping case initiated by China, through the contrastive analysis of the before and after anti-dumping for the potato starch, it found a series of economical indexes all markedly improved after the anti-dumping measures. In consequence, China should utilize the anti-dumping measures to protect its own rights so as to promote the healthy development of agriculture.(4) The application of China's anti-dumping has the following problems: lack of the alarm system, the deficiency of relevant legal awareness, ineffective industry association, and insufficient anti-dumping. In order to effectively utilize the anti-dumping and promote the healthy development of industry,the Chinese government is supposed to set up an early-warning mechanism,raise the awareness,exert the action of association as well as enhance agricultural competition.
