Resale right originated in the early 20th century in France. Since the 19th century, the number of french artists have increased and the art market became more and more prosperous, but at the same time, the contradiction between the artist and the art dealers were also increasingly prominent. In order to balance the distribution of benefits between painter and art dealer, France created a system of droit de suite in its copyright law with the spirit of equity and justice in 1920, then the resale right was emulated by Germany, Italy and other civil law countries. In 2001, the EU proposed 2001/84/EC Directive which required EU member states to put droit de suite legislation into force before January 2006. When the EU countries follow the legislation, the United States is still reluctant to implement it.March 31,2012, the China's National Copyright Bureau and Publication Administration official's website announced the first draft of the modifications. "People's Republic of China Copyright Law" first introduced the "droit de suite" concept. The draft suffered strong opposite voices outside. Lack of market research, it has not been formally put into law.This paper will use case analysis, quantitative analysis and qualitative analysis to study the impact. Through the case study overseas, collection of documents in different periods of States government, bills of implementation, the report of the art market data as well as major institutions where experts and scholars of monographs summarized the impact of droit de suite. Through domestic art market research, this paper tries to explore the inspiration and meaning for China, and give the conclusion of the non-necessity of implementation in Chine.
