Song Jiaoren's Legal Thought Research

In modern and contemporary Chinese history, Song Jiaoren is a typical and advanced bourgeois politicians, who turned to western countries to find the truth, meanwhile, he is the forerunner of the national bourgeois that spread and practise western legal thoughts in China. During his study in Japan, he got the profound understanding of western democratic constitutionalism, then he advocated positively carry out the constitutionalism and struggled for run to pursue and achieve a democratic constitutional government. Throughout the Song Jiaoren's short life, he contributed the industrious endeavor to establishing the legal society and real democratic republic system. This theory draws a general conclusion of Song Jiaoren's legal ideas, including constitutionalism, international law, administritive law and corporation law, which mainly is based on the relatively abundant history material on the basis of legal theory, and combines with the relevant knowledge of historiography and politics. It is divided into three parts, the first part, that is Chapter1, primarily illustrates the basic information and the history background of his life, and offers the overall grasp of social origin from the major aspect of social, where Song Jiaoren's legal thoughts come from. The second part, covering Chapter2, Chapter3, andChapter4, is the main part of this theory. These four chapters specifically discusss Song Jiaoren's thoughts on constitutionalism, international law, administritive law and corporation law respectively, among of which concentrates on the the thoughts of constitutionalism and international law. The third part, which is the summary of the theory, outlines the historical influence and limitation of Song Jiaoren's legal ideas and the real enlightening significance of today's socialist legal construction.
