On The Construction Of Dispute Resolution Mechanism For Residential Property Services

Along with the development of Chinese economic since the reform and opening up, the development of the real estate industry achieved by leaps and bounds. In the meanwhile, the property service has sprung up and grows norm and maturity gradually. However, we also witnessed that various property disputes have been arising for different reasons with different types, and becoming more and more complicated. The current litigation settlement system and non-lawsuit settlement system keep independent from each other, lacking effective and positive interaction which can help to control the whole process of property disputes. Numerous different types of property disputes narrowed the way for the further development of property service.Disputes of property service appear many a time in residential areas which served as basic social unites can be easily ignited to mass disturbance, which is one of the adverse factors on the harmonious society. Thus I find it is meaningful to have a detailed analysis on the current situation of property service industry and the problem in the settlement system. My paper will start from the disputes in property service and make necessary introductions of foreign dispute-settlement system, which is a reference experience for us. On that base, I try to construct my own solution system to the disputes in principle of overview, coordination and interaction. Firstly, I focus on the legislation, administration and the property contract parties, taking analysis on the institutional construct before the disputes emerged. Secondly, I try to give my own solution of construction the settlement system in the property service industry in combination with the reality in our country, which can positively interact with arbitration and ligation in company with other settlement system, hoping to settle the property disputes effectively.The harmony and stability of the society is the ultimate goal of the institutional construction. How to improve the current legal system, making up the deficiency of the current dispute-settlement system in order to settle the disputes perfectly as well as building a pleasant living environment in residential areas, promoting the healthy development of property service industry are all what I consider to write in this paper.
