On The Improvement Of China's Legislation Of Punishing Terrorist Crimes

After the "9.11" incident terrorism crime is growing, constantly challenged the moral bottom line of ethics of human society, seriously affecting peace and development of the world, the security and stability of the region. In recent years, the crime of terrorism in our country is also showing a frequency and a high incidence of the situation. This seriously hindered the process of the construction of harmonious and peaceful society. With the help of mandatory legal means to punish the increasingly rampant terrorism crime, has become the consensus of the international community. Strengthen anti-terrorism legislation, perfecting relevant legal countermeasure research be imperative, brook no delay. Chinese law clearly against the violent terrorism crime and the Chinese government actively respond to international cooperation against terrorism. But in the punishment of the crime of terrorism legislation, particularly legislation of international anti-terrorism cooperation, China has lagged behind. Summarizes the problems analysis of China's punishing crimes of terrorism legislation practice, learn from international advanced experience and improve the legal results of anti-terrorism, will help improve China's punishment of the crime of terrorism legislation, strengthen international cooperation against terrorism, to punish terrorist crimes, to promote peace, construction of Harmonious Society of great significance Chinese.This article explains the concept and legal characteristics of the terrorism crime, through the analysis of reference on the Legal Countermeasures of international punishment of the crime of terrorism, and combined with our country's anti-terrorism legislative practice, legislative measures are proposed to improve the punishment of terrorism crime in china. In addition to the introduction and conclusion, this paper consists of four chapters. The first chapter is an overview of the basic issues about the crime of terrorism, the definition of the concept of terrorism crime, and analyzes the historical origin and development trend of crimes of terrorism; the second chapter is the analysis of the international law to punish terrorism crime, this chapter from the introduction of western main developed countries of anti-terrorism legislation experience, analyzed the legislation characteristics of punishing the crime of terrorism, and introduces the international anti-terrorism agreement; third chapter is the introduction and analysis of China's legislative practice of punishing the crime of terrorism and the main problems, this chapter introduces our country legal practice in the aspect of punishment of the crime of terrorism, and then analyze the legal dilemma of our country against terrorism crime; the fourth chapter is to perfect the legal countermeasures against the crime of terrorism in our country, mainly on which pattern should be chosen for the anti-terrorism legislation, the legislation principle, as well as anti-terrorism special law, perfect our current criminal law.
