Research On The Anti-terrorism Legislation In Our Country Combined With The Modern Terrorism Crime

Since 1990s, with the end of the cold war, the formation of a multipolar world,global interest groups conflicts, some extremist ideology represented by "Pan-Islamism and Pan-Turkism Ideology" were used by terrorism, causing terrorism crime increasingly active. Since the "9 ·11" terrorist attacks, international terrorism spread rapidly, most countries have introduced and perfected the anti-terrorism laws and regulations. Chinese is also faced with the "three forces" as the representative of the terrorism forces continued invasion penetration. Terrorism crimes gradually spread from Xinjiang to the mainland, and gradually become an extreme threat to Chinese national security,public safety,personal and property safety of citizens. Compared with other common criminal acts,the terrorism crime's is clear and characteristic with obvious and great harm, it is urgent to promote the improvement of anti-terrorism legislation on the fight against terrorism crime. In our country, the first anti-terrorism Law"Anti-Terrorism Law" was formally promulgated in January 1, 2016. With the publish of "Anti-Terrorism Law", China entered a new stage with "Anti-Terrorism Law" as the guide, criminal legislation and administrative legislation as the main content, other legislation as the supporting of the anti-terrorism law system. But we should also see the definition of our anti-terrorism legislation including key law concepts,penalties setting and charges setting, connecting and supporting between the relevant laws and protection of human rights. This article reviews terrorism crime's origin, concept, status and characteristics and the process of Chinese anti-terrorism legislation. With the research of the problems existing in our country's anti-terrorism legislation, the article throws out some suggestions on how to improve and perfect the legislation system of anti-terrorism in our country. One is to improve the supporting between "Anti-Terrorism Law" and criminal legislation. Define key concepts, Add specific charges and classified charges.Two is to improve the supporting laws and regulations after the "Anti-Terrorism Law"was issued. To seek the constitutional basis for anti-terrorism legislation, perfect relevant implementation details, administrative laws and regulations, to fill the gaps in the relevant laws and regulations. Three is the protection of human rights. In order to fight against terrorism crime, we had to expand the public power moderately, but we also must ensure that citizens' legal rights are not violated by the public authority which is out of control.
