On The Criminal Law System Of Domestic Violence

As our country is in the social transitional period,family violence has been more and more serious. Even though the country has publicize a series of laws like Criminal Law, Marriage Law,Tort Law and Law of Public Security Administration, but due to the provision is too loose and lack of concrete measures, it lead to the law cannot cover all aspects of the domestic violence crime. Especially the criminalizing standard is too high and lack of pertinence, appearing as it should be, can not fundamentally eliminate the serious social harm of domestic violence. This paper will analysis from two aspects,has been included in the criminal law system of domestic violence crime and has not been included in the criminal law regulation system of domestic violence crime. The essay analyses by introducing from the typical cases the controversy point of the above mentioned issues, public view and the author's own opinions. It points out the flaws of the current criminal law and legislation difficulties for the two cases and further indicates the legislation necessity and theory bases. In summary, the author suggests for setting up a new law against family violence, implementing evidence producing liability reversing system, and establishing unified evaluation standard of emotional trauma and standard of emotional abuse times and offers detailed advice on enhancing people's awareness of proof collecting.
