Continuous progress of human civilization deepens the publicity of human rights all over the world.Reproductive rights,a kind of fundamental human right,have been recognized in the world.As a special group,reproductive rights of prisoners have been neglected for a rather long time in populous China.Their freedom being restricted,prisoners still have their reproductive rights.It's not only the reflection of a country's progress in relation to respect and protection of human rights,but the need for more progress of legal society to protect fundamental human rights for prisoners.Since prisoners' reproductive rights are not expressly deprived of by the law,prisoners are still entitled to reproductive rights according to the law spirit: only law can forbid one's behavior.For now,regulations concerning prisoners' reproductive rights are rarely involved in our current law.In recent years,law awareness of people gradually increases and the concept of human rights takes root in our mind.Therefore,a growing number of prisoners appeal for exercising their reproductive rights.However,their appeal often fails due to issues gaps in field of legislation,judiciary,law enforcement and their limited personal freedom and difficulties in prison agency execution.Taking this into consideration,the author believes that it is necessary for deep study of prisoners' reproductive rights in order to make relevant recommendations for prisoners' reproductive rights protection.This thesis is divided into four parts from the logical structure,introduction and conclusion included.The basic theories of reproductive rights are introduced in the first part,coupled with the combing of China's Constitution and relevant laws compared with domestic and foreign laws in prisoners' reproductive rights protection.Prisoners' reproductive rights,basic human rights,are fundamental rights,statutory rights and civil rights.And the current situation and dilemma of prisoners' reproductive rights is analyzed in the second part,including conflicts from multiple aspects.And the necessity and feasibility of prisoners' reproductive rights protection is discussed in the third part,its significance and value as well.And part four presents recommendations for improving prisoners' reproductive rights protection in order to achieve full protection of their reproductive rights.
