| The improvement of material and the development of science and technology make the TV media industry developing rapidly, and present a diversified situation. There are more and more excellent variety shows on the TV. Television stations in order to maintain its competitive advantage, they buy shows from abroad or splurged on copyright, or reference to draw lessons from cloning existing popular TV show in order to save costs. But these two approaches are not reflected in the current law of our country. As the imitation plagiarism phenomenon appears in great quantities, it causes disputes between international and domestic television program manufacture group. Aim at the TV model copyright disputes is also increasing, and scholars' views differ on this question, therefore it is urgent to set up TV legal protection system. This paper argues that utilizing the model of “copyright law” to protect television position, at the same time, this paper utilizing the “trademark law”, the “patent law” and the “anti-unfair competition law” to assist, even it can through legislation named “the television media law” to improve the protection of TV programs.This paper is divided into three chapters. It analyzes the TV mode of protection. The first chapter explains the concept of TV program mode, scholars from Chinese and abroad theory connotation and extension of TV mode, and then value the TV model to demonstrate the importance of protecting our TV model. The second chapter analyzes the TV mode's protection status quo and difficulties. Finally, it determines using copyright law to protect TV model, at the same time, put forward a series of suggestions such as infringement cognizance to solve the dilemma, it will make model of the TV programs consummate. |
