| The purpose of ‘Urban-Rural Planning Law of People’s Republic of China’ which had implementation in 2008 is to adjust various kinds legal relations from planning activities.With the implementation of this law,basic legal system of public participation has been constructed in urban-rural planning.Legal system of Urban-Rural Planning Law has been gradually improved since founding of People’s Republic of China which has also reflected the changes and developments of political and economic system in China.Public participation take part of general governmental work is due to well promoted political democratization in each country of the world.‘Urban-Rural Planning Law’ is public administration legal norms therefore public policy is one of its characteristics.So,public participation should play an important role in urban-rural planning and construction because urban-rural planning is one of the key actions to government administration.However,public participation is still imperfect in planning system now in China.By legislation,due to misty law provision of public participation power in Urban-Rural Planning Law,public participation itself is more symbolic.By specific embodiment,lack of effective channels for public feedback and assistance from non-government organizations are the main reasons to the low public participation.Therefore,government should draw on strengths from successful cases in developed countries and analyze the causes of low public participation in China.This paper will focus on legislation and specific implementations of urban-rural planning in China and then come with reasonable suggestions.Composed by four parts(introduction and conclusion excluded),this paper will analyze the public participation in urban-rural planning system.The first part will focus on definitions to public participation and urban-rural planning system.According to domestic conditions and needs,this part conclude that public participation is the necessity to urban-rural planning.Due to legislation is fuzzy,fluidity and lags of participation in urban-rural planning in China,the public participation in planning system are facing 3 major difficulties as followed,lack of assistance from non-government organizations,low participation from medium and intellectuals and poor public access and feedback.These 3 difficulties will be the focus for part 2.Part 3 will focus on comparisons between German,England,United States and China at legislation of public participation in urban-rural planning and take advantages from their successful cases.Last part will further discuss 2 difficulties mentioned in part 2 on drawbacks facing to public participation in urban-rural planning system and will propose amendments to lack of assistance from non-government organizations,low participation of medium and intellectuals,poor public access and feedback and incentive methods to encourage more public participation. |
