On The Application Of Technical Investigation In Duty Crimes

Duty crime belongs to high-tech,high intelligence-type crime,is a kind of concealment is very strong crime.With the advent of the information age,payment methods and the emergence of electronic banking,procuratorial organs in the handling of the case,the use of conventional means of detection is difficult to obtain effective evidence of duty crime.The Criminal Procedure Law promulgated in 2012 provides the legal basis for the procuratorial organs to investigate the application of technology investigation in the case of duty crime.But did not give prosecutors the power of technical investigation,which resulted in the application of technical investigation measures in the process of public security organs to accept applications is not timely,the procuratorial organs and public security organs poor communication,application of technical investigation and approval procedures are too cumbersome and so on.Therefore,it is urgent to construct a new system and a new standard to carry out technical investigation measures by the procuratorial organs so as to ensure the correct and effective use of technical investigation measures in the investigation of duty crimes.
