Abstract/Summary:
At present,with the development of real estate in our country economy and the deepening of the housing system reform,housing rental market is very active,house lease dispute also increases,especially the building relet,appended content on the ownership of the lease term,rent an illegal aspects of legal relationship is complex,there are many disputes in judicial practice and confusion,as a result,applicable law of house lease dispute is studied deeply,is of great necessity and urgency.The main content of the research include:the introduction part analyzes the significance of this writing,the topic research present situation,content and research methods;Text in the first part firstly enumerates the building to rent a legal dispute case study,the following for rental case problems reflected in the detailed analysis of the applicable law;The second part is to the lessee subleases the applicable law of analysis,this paper briefly introduces the main countries in the world the pattern of legislation about relet,and points out that the lessee to decide how to relet,further analysis of the legal consequences;Discusses the lessor to exercise the right of the termination of the contract and limitations,and the legal relief of multiple sublease behavior;The third part from the point of view of appended objects belonging to the analysis of legal application;From two aspects of designing rules and judicial process of house lease appended material on the ownership of the problem;The fourth part in view of the illegal building lease contract was analyzed,and the applicable law,this paper discusses the legal effect of lease contract and illegal buildings dispute relief way.The last part is conclusion.
