Research On The Supervision Of Vulnerable Children

Minors are the future and the hope of our country.Protecting minors and giving them more cares is the responsibility of the state and society.Vulnerable children is a special group of minors,because of the particularity family background,vulnerable children in practice often faced exclusion and discrimination from the external environment.Only solve the problems of vulnerable children guardianship,the rights and interests of vulnerable children can be protected by the law,and the vulnerable children can grow smoothly in a better environment.The purpose of this paper is to starting from the perspective of protecting the legal rights of vulnerable children,discussing the guardianship problems and countermeasures of the vulnerable children in China.This paper is based on the topic of "Research on Guardianship Problems of Vulnerable Children".There are four parts in my paper.The first part is a general statement of the vulnerable children in our country.Firstly,it defines the meaning and characteristics of the vulnerable children.Secondly,it elaborates the basic theory of the guardianship system.The second part is the overview of the vulnerable children guardianship in China.Firstly,it introduces the current situation of guardianship of vulnerable children in our country.Secondly,it introduces the relevant legislation concerning the custody of vulnerable children.Finally,it analyzes the problems existing in the custody of vulnerable children,including unclear "children Best interests"principle,the stipulation of guardianship duty is more ambiguous,it is not appropriate to revoke the qualification of Guardian,lack of supervision of guardianship of vulnerable children.The third part is the situation and enlightenment about the guardianship of vulnerable children in some countries.This part mainly introduces the relevant legislation of guardianship of vulnerable children in the United States,Britain,Germany and Japan and summarizes the characteristics of guardianship of vulnerable children in these four countries,which provides reference for solving the problems of the guardianship of vulnerable children in our country.The last part is about the problems existing in the guardianship of vulnerable children in our country which is the most important part of the paper.Firstly,it expounds the practical meanings of solving the problems existing in the guardianship of vulnerable children in our country.Secondly,from the problems existing in the guardianship of vulnerable children,I will put forward some suggestions,including establishing the principle of "the best interests of the child",clearing guardianship duties entrusted by the rules,perfecting the revocation of the provisions of guardianship qualification,to enrich the provisions of the state guardianship of guardianship,supervise the guardianship of the guardian of vulnerable children.
