Children are the hope of families and the future of the country and nation.According to the results of the sixth population census,the number of children between 0 and 18 years old is 300 million,accounting for 22.5%of the total population of China,which explains that it is important to protect minors.With the increase in the number of drug users in China and the massive capture of drug-related criminals,Drug-related persons with minor children are in a state of lack of guardianship or guardianship during the period of detoxification,serving a sentence or being forced to quarantine in the community,Cause such children to face difficulties and threats in life,safety,education,psychology,socialization,etc.,The growth of childhood is an important stage in the development of life.Therefore,the protection and relief services for children in distressed families are particularly important and urgent.In this context,this study takes the underage children of drug-related families in nanjing as the research object,and mainly studies two questions:What difficulties did social workers encounter in the process of guarding the minor children of drug-related families?How social work solves the Guardianship dilemma in service and maximize the interests of children?This study is helpful to enrich the knowledge of the Guardianship dilemma of minor children in drug-related families and deepen the study on the guardianship difficulties of social work in the services for the minor children of drug-related families.Putting forward targeted countermeasures,which will promote the improvement of relevant policies and regulations for children in drug-related families,and provide some practical experience reference for social work in various places,so as to promote the further development of children's social work.Based on the theory of social ecological system,this study analyzes the difficulties existing in the various systems of the children with drug-related families.Adopting qualitative research method.The methods of collecting and analyzing data include literature research,case study and observation.Based on the analysis of empirical data,this paper describes the basic situation of children suffering from drug-related families in Nanjing and the service status of administrative departments and social organizations to children in distressed families,Three types of drug-related family distressed children with different characteristics were selected,select a case for each type of drug-related family distressed child,Starting from the description of the practical process,the Guardianship dilemma of each type of monitoring is analyzed,and the idea of solving the guardianship dilemma is proposed.There are some Guardianship dilemma in the services for drug-related family troubled children cared for by relatives:the division of powers and responsibilities of temporary institutions during the period of asylum is not clear,whether to need to evaluate the temporary guardian care motivation,how to assess temporary guardian's ability to fulfil his guardianship,The rights and interests of children in distress in relatives are difficult to protect.Putting forward specific suggestions:clear rights and responsibilities,equipped with professional personnel to deal with cases of minors;To evaluate the motivation of relatives for temporary care according to the rules of temporary foster care evaluation;Comprehensive assessment of the ability of the temporary guardian to perform guardianship;The national policy level carries on the directional instruction,refine laws and regulations.There are some Guardianship dilemma in the services for drug-related family troubled children cared for by foster families:The relevant systems and procedures for household registration are in urgent need of improvement;Social workers,foster parents and other temporary guardians are too complicated when visiting the prison;The rights and responsibilities of foster families for distressed children need to be clearly regulated.The transition of foster children from foster home to return to their native family is challenged.Putting forward specific ideas:adhere to the principle of non-discrimination,improve the household registration system;the public sectors open a green channel to help build a bridge of love;to regulate the rights and responsibilities of all parties to safeguard the plight of children and their foster families;the social worker assists and supervises the foster family and helps the client to change his/her role.In the process of providing services for the abandoned children in drug-related families,there are such difficulties in the custody of children:the legal guardian after drug abuse and drug trafficking is released from prison and refuses to perform legal guardianship duties,the seemingly rigorous network of guardians appears in the loopholes for children in drug-related family situations,guardianship of children with drug-related family difficulties should insist on parental rights or state parental rights;In view of these difficulties,the author puts forward some ideas:support and reconstruction of children's custody intervention in drug-related family difficulties;supplement and improve relevant laws and regulations,let social workers who are engaged in the protection of minors have laws to follow;take children's well-being as the center,and replace parental rights by state infringement when necessary.
