The construction land can be divided into state-owned construction land and collective construction land according to the ownership of the ownership.The ownership of the collective construction land is owned collectively and the farmers enjoy the right to use the collective construction land.All along,China has implemented urban and rural dual land system.Urban construction land can be free to flow,and rural construction land is almost prohibited circulation.In recent years,the continuous development of China's urbanization has also put forward new demands on the circulation of collective construction land in China.After the Third Plenary Session of the Eighth Central Committee,China has introduced a series of documents on the collective construction land to make new provisions,and gradually allow the collective construction land for circulation.All over the country for the needs of economic development,have broken through the boundaries of the law for collective construction land transfer pilot reform.However,due to the lack of uniform legal provisions,all localities in accordance with the local normative documents to carry out reform,which will appear different standards of compensation,construction land transfer after the farmers social security problems difficult to solve,damage the rights of farmers and a series of issues.Therefore,it is necessary to analyze the existing problems and suggestions on the circulation of rural collective construction land and put forward the relevant legal system on this basis.
