Study On The Administrative Law Of The Residence Permit System

Since the reform and opening up,China’s market economy has been deepened,industrialization and informationization have developed rapidly,and the level of urbanization has been improved.The demographic structure of our country has changed dramatically and the reform of household registration system is imperative.However,China is still in the economic and social transition period,the traditional urban and rural dual differentiation is still deep-rooted,the current reform of the household registration system is not yet have objective conditions.Residence permit system in this context into the stage of history,is the soft landing of household registration reform,and will be in a very long period of time to bear the floating population service management,mediate the city limited resources and population structure of the important role between the contradictions.However,there are still many problems in the current residence permit system.If the implementation level is uneven,the coverage process of residence permit is slow,the supporting legislation and public service are lagging behind,the welfare treatment is not in place,the perfect population information base is difficult to establish,the administrative legislation is insufficient,Functional departments can not form a joint force.This paper studies the residence permit system from the angle of administrative law.This paper discusses the basic concept,main contents and the present situation of the residence permit system,analyzes the problems and causes of the residence permit system,and puts forward three suggestions on the improvement of the residence permit.The full implementation of the residence permit system is to promote the healthy development of the new urbanization,promote the basic public services in urban areas and facilitate the full coverage of the resident population,protect the legitimate rights and interests of citizens and promote social fairness and justice.But must recognize the residence certificate is an overdue product.Therefore,in the process of living permit system,we must keep pace with the reform of household registration system.Breaking the dual structure of urban and rural areas,to achieve the freedom of movement of the population is the new stage of the goal of change.With the deepening of the reform of the household registration system,the free movement of population pressure on urban resources carrying capacity is getting smaller and smaller,the residence certificate will eventually withdraw from the stage of history.Therefore,at the present stage,we should strengthen the legislation of the residence permit system,improve the system security,improve the administrative capacity,innovate the administrative means,and gradually realize the urban welfare of the floating population to share the benefits of the city,provide valuable experience for the in-depth reform of the household registration system.
