| The enterprise rules and regulations are the effective combination of the enterprise management right and the democratic management right of the employees.It is an important way to coordinate the labor relations and can obtain the balance of interests between the two sides of labor relations.Labor law provides that enterprises to develop enterprise rules and regulations is both its rights and theirs obligations,not only reflects the respect for the enterprises self-management,but also reflects the protection of the rights and interests of workers.Reasonable and legitimate enterprise rules and regulations are both the needs of national legislation,and the needs of independent management of enterprises,for the normal production and operation of enterprises and the establishment of harmonious and stable labor relations have far-reaching significance.Because the legislation is unclear,there are many problems in the subject,content and procedure of the enterprise rules and regulations in practice.There are many labor disputes which have a negative impact on the development of enterprises and the protection of the legitimate rights and interests of laborers.After the legal analysis of the above problems,the corresponding suggestions are put forward.By drawing lessons from the experience of foreign advanced countries or regions and combined with China’s actual formulation of the main body,set the principle of the provisions of a clear democratic procedures and other specific recommendations,in order to promote the development of China’s corporate rules and regulations. |
