Research On The Legal Issues Of China's Auto Finance

The development of automobile finance can not only promote the promotion of automobile sales,but also play an important role in promoting the upgrading of China's automobile industry,and then promote the transformation of the national economy.China's auto finance since the last century since 90s has been developing for more than and 20 years,but compared to the auto finance mature market countries,there is still a big gap in the overall financial permeability:Automobile in automobile sales is not high;the business model is still in the traditional automobile credit,car leasing and second-hand car financial and other new business development is not smooth,risk control ability is not strong;professional auto finance companies still dominate the market;disturb the market competition order and the violation of consumer rights and other illegal acts have occurred.The root cause of these problems lies in the imperfect legal system of automobile finance in china.Firstly,related concepts of automobile finance and legal relations are discussed,and then combined with the status quo of China's auto finance development and regulation of the analysis of the problems in the development of auto finance in China:the illegal seizure of illegal acts of dealers in the new certificate for financing and auto financial companies for commercial bribery to the dealer two kinds of representative of legal analysis and qualitative;on auto financing lease the lessor faces serious legal risk,the second-hand car business is limited to these two emerging business problems from law angle are analyzed;on the development of Auto Finance Company Limited of legal analysis from two aspects of market access and financing channels.Finally,to solve these problems from the improvement of auto finance business related laws and regulations,improve the auto financial supervision system and the three aspects of financial supporting legal system of automobile countermeasures are put forward in order to improve and provide legal protection for the development of China's automobile finance.
