The Exit and Entry Administration Law of the People’s Republic of China was adopted at the 27 th meeting of the Standing Committee of the National People’s Congress of the People’s Republic of China on June 30,2012.With the increasing development and improvement of the exit and entry legal system in the past decades,it has a new begining.More emphasizes have been placed on the protection of state sovereignty and security and the legitimate rights and interests of entry-exit people in the Exit and Entry Administration Law,which plays greater roles.Despite those progress,there are also many problems,such as the limitation and degree of the protection for state sovereignty,the hindering the development of the market economy,the limitations on the promotion of opening up and so on.There is a integration of all laws and regulations concerning the exit and entry administration in the Exit and Entry Administration Law,which plays an important role in the nationality administration,eapecially in the administration of “three-illegal” foreigners.The Exit and Entry Administration Law is the innovative development of exit-entry administration system,plays a positive guiding role in improving the entry-exit administration system,and opens a new chapter in the enforcement of laws and regulations on entry-exit administration.Besides,advanced law enforcement concept,perfect law enforcement system and professional law enforcement bodies will ensure the best social effects and legal effects of entry-exit law enforcement work.However,several aspects concerning strengthening the punishment of “three-illegal” foreigners,perfect the legislation of the procedures,and the adequate legal remedy for foreigners need to be improved further.
