Research On Administrative Legal Procedures For Changing Road Names

With the rapid development of China's economy,as part of the municipal construction of the road with each passing day,and the name of the standardized management of the real relationship to the local people's life travel.Thus it has certain theoretical value and practical significance to study whether the name change of current road is legal,what the existent administrative legal procedural matter is,and how to solve it.At present,the existing regulatory document of road name change in our country is Regulations on Place-name Administration issued by the State Council in 1986,Enforcement Regulation on Place-name Administration issued by Civil Affairs Ministry in 1996,and some regulations formulated by local government in consideration of the actual local situations such as Regulations on Place-name Administration in Henan Province,Regulations on Place-name Administration in Beijing City,and Regulations on Place-name Administration in Zhengzhou City.As these rules,regulations and normative documents was introduced earlier,they have lagged behind the municipal construction and have various problems on subject,variation procedure and remedy means of the name change.Therefore,according to the present social cases of road name changes,the administrative legal procedure of the road name change will be discussed and improving suggestions will be proposed through a variety of research methods.This paper includes three parts.The first part is conducting practical survey about administrative legal procedure of the road name change in China.Firstly,the concept of road is proposed by combing of literature,and take example of the cases of road name change in the real life to point out the negative effects on the relevant people caused by road name change.And then point out the administrative legal procedural problem on current road name change,furthermore,show the necessity of standardizing administrative legal procedures in road name change.The second part is the cause analysis of administrative legal procedure problems existed in the procedures on road name change.Firstly,from the disclosure of administrative information,analyze that the problem of administrative information disclosure in the procedure on road name change is caused by imperfect laws and regulations as well as the conservative ideas of the administrative information public main body.Secondly,analyze that problems of public participation in the procedure on road name change is caused by lagging laws and regulations and deficient public participation rights protection system.Finally,due to the imperfect regulations on relief approach and deficiency of judicial remedy,there are problems on relief ways in the procedure on road name change.The cause analysis on these problems provides theoretical support for the improvement of the administrative legal procedure on road name change later.The third part is the improving suggestions on the above-mentioned existing problems on the procedure of road name change.First of all,improve the administrative information publication system through fostering new concept of service administrative Information disclosure,enriching the ways of administrative information disclosure and standardizing the procedures of administrative information disclosure.Secondly,establish and improve public participation mechanism in road name change through fully guaranteeing people's right to know,establishing all kinds of public participation mechanism and establishing expert decision-making consultation system of road name.Finally,suggest the citizens whose rights were damaged,to settle debates caused by road name change through administrative mediation,administrative reconsideration and administrative proceedings to perfect rights and interests relief of administrative legal procedure in the road name change.
