Research On The Status Quo And Legal Countermeasures Of Community Correction Work In Lhasa City

Community correction refers to as opposed to a prison correctional non-confinement penalty execution mode,will conform to the conditions of community correction of criminals in the community,whose conditions by the specialized state organs in the related social groups and non-governmental organizations and volunteers,in the written judgments or orders of the court and the prison or the decision to determine the time,correct criminal unhealthy psychological and bad behavior,and promote the criminal smoothly to return to the non-confinement penalty enforcement activities of the society.Community correction is a formal way of penalty execution system design,which has hundred years history in the west.In many countries of the world,because of the community correction has many advantages,such as reduce the pressure on the management of the prisons,avoid the cross infection between prisoners,decrease the cost of punishment execution.These advantages make the community correction has been in the criminal justice system in many countries of the world dominance,Community correction in China is late,however,Lhasa in 2010 run.The article is based on this background,the main study of Lhasa several aspects of the community correction.Chapter one,the introduction contains for the content of the thesis research background,research purpose and research of theoretical and practical significance,the research status quo of community correction,the research train of thought and method,and the innovation research object,research content and the shortage of demonstration and data collection.Chapter two mainly introduces the definition of community correction.Community correction has the basic characteristics of humanistic care,non imprisonment,community participation,criminal sanctions and so on.Community correction task is in accordance with thelaws and regulations about community correction object to strengthen supervision and management to ensure punishment implemented smoothly.Take many forms to make the community inmates law-abiding citizens.Community correction involves four kinds of people,people sentenced to public surveillance punishment,be ruling on parole,temporary execution outside prison.Community correction is helpful to overcome the disadvantages of prison correction,ensure corrective effect,is in line with the international practice in the field of criminal justice.In addition,this paper introduces the community correction of penology,criminology,sociology theory.Chapter three described the history and present situation of Lhasa to promote community correction work,including Lhasa mechanism,achievements and experience from 2010 to 2016 in order to boost the construction of community correction.Chapter four involved in Lhasa community correction work problems and cause analysis.Main problems include no enacted the national community correction law,pretrial social investigation,community correction team need to improve professional quality,lack of talent,difficult to manage community correction object.The reasons of the problems having a team of legislative factor,system factor,factors,thoughts.Chapter five try to perfect the Lhasa community correction legal countermeasures from three angers.Legislative measures are to perfect the relevant legal community correction system.Judicial countermeasures mainly include strengthen the publicity of related work of community correction and improve the ordinary people in Lhasa and law enforcers' identity in the community correction.Administrative aspects of the countermeasures are to deep the operation and management system of community correction.Based on the above chapters,if in Lhasa and in the Tibet autonomous region want to effectively regulate the work of communitycorrection in promoting community correction work,properly solve the problems,will form the prison-prison sentence for rehabilitation as a very good supplement.Coordinate between them,will be a very good effect of penalty execution,harmonious social stability in ethnic areas,helpful to protect human rights.
