The Comparison Of Community Corrections Between China And Foreign Countries And The Perfection Of Community Corrections In China

The community corrections develop under the background of the socialization and the humanization of penalty execution, which reflects the development trend of penalty system from the imprisonment to the socialization of penalty execution. The community corrections have been well developed in western countries, and the theory also nearly perfect, which could be used for reference and have a very deep significant meaning to our country's community corrections development. The paper tries to find out the problems of our country's community corrections by the comparison between the foreign community corrections system and our own. At present, there exist such problems in community corrections in our country as follows: the rate of application of community corrections is much lower than that of the foreign countries; the legislation concerned the community corrections is not adapt to the circumstance in reality; the execution system and monitoring institution need to be perfect and so on. So it's very necessary to use the foreign countries' advanced experience in community corrections for reference.This paper in proper is made up of five parts:Part one mainly focuses on the outline of the community corrections including the clarification of some concepts concerned with community corrections and the definition of the concept, then the common and different characteristics shared by the foreign countries and our own in community corrections.Part two focuses on the condition which gestates the growth and development of the community corrections and tries to analyze it from two parts which include the economic condition and the advanced ideas in the aliens and the home.Part three mainly sums up the forms of the legal norms concerned the community corrections in deferent countries, and then makes a comparison of categories of community corrections between the foreign country and our own.Part four mainly tries to distinguish and analyze probation and parole which exist in both our country and foreign countries. And then try to get some revelations to our country.The last part focuses on putting forward some suggestions based on the contents in the above chapters, which are about how to perfect the community corrections in our country. Those suggestions are expected to be significant to the development of the community corrections in our country.
