Research On Legal Aid For Migrant Workers In Jinshui District Of Zhengzhou City

In recent years,in the process of promoting the city,into a large number of migrant workers,they played an important role in the construction of the city.However,a large number of violations of the legitimate rights and interests of migrant workers have emerged.As an important system to protect the basic rights of citizens,legal aid effectively protects the legitimate rights and interests of migrant workers.Jinshui District of Zhengzhou as the central city of Henan provincial capital,has richly endowed by nature geographical advantage and more high-quality resources.Attracting a large number of migrant workers to Jinshui district,however,they are for the construction of national capital service at the same time,encountered infringement disputes more and more,the number of legal aid cases is increasing year by year.The number of legal aid cases of migrant workers in Jinshui District accounts for about 50% of the total number of legal aid cases,so it is necessary to study the legal aid to migrant workers.This paper is based on the extensive collection of domestic and foreign research results.On the basis of the theory of equal protection,human rights protection and rights remedy,the data were analyzed by questionnaire and empirical study.Based on the demand level,the supply level,the reality of the status of legal aid first-hand information,objective analysis of migrant workers in the phenomenon of serious labor violations,high cost of rights,legal aid is not perfect,channel is not smooth and other reasons,and the impact of migrant workers legal aid analysis.The legal aid system in China has experienced 13 years of development,has made considerable progress and played a larger role,but there are still many deficiencies and shortcomings,performance in legislation and practice,there are no special laws and regulations.In practice,personnel and financial security is not in place and so on.Especially in the legal aid to migrant workers,the problem is more prominent.On the one hand,there is a problem of legal aid for migrant workers,labor contract signing rate is low,the rights of the channel is not smooth,high cost of rights.On the other hand,the lack of rights of migrant workers,the main reasons and the main problems of legal aid for migrant workers clarify the framework of migrant workers rights,put forward practical solutions.First of all,starting from the establishment of migrant workers rights organizations,broaden the interests of migrant workers express channels;Secondly,from the rights program,the reform of the labor dispute settlement mechanism after the first trial,set up a special labor court trial committee;Third,from the solution,the three options: people's mediation,court proceedings,labor arbitration;Fourth,from the protection mechanism,improve the team,ensure funding,strengthen publicity,simplify procedures,the establishment of off-site,regional cooperation mechanism..The author investigates the current situation of migrant workers,based on empirical data,first-hand information,which are found in the field of practice for legal aid for migrant workers,to find out the countermeasures and suggestions to solve.At the same time,the main body of this paper is to study the content of migrant workers,is associated with the laws and regulations of the subject,with the interdisciplinary nature.
