Ecological environment is closely related to human beings.In recent years,the party and the state proposed the importance of building ecological civilization,ecological environment has become increasingly prominent.However,the ecological environment in our country is still facing a severe situation,the rule of law is an important means to solve the ecological environment problems,and the fight against environmental crime is the basic guarantee of environmental law.The research on the crime of ecological environment,especially the positive investigation.Ecological environment crime is a general term for a series of crimes that destroy the ecological environment.It has the characteristics of concealment of manifestation,complexity of causality and severity of harm result.The constitution of ecological environment crime includes four elements: subject,subjective aspect,object and objective aspect.Prefecture of Qiandongnan Guizhou Province,although the ecological environment,but in recent years,the high incidence of crime in the area of ecological environment,and showed a rising trend,16 counties statewide court accepted the annual ecological environment especially the number of criminal cases involving forest resources,the number of criminal cases in Guizhou province has accounted for nearly 1/3 of the total similar criminal cases.How to reduce and prevent the crime of ecological environment is related to the construction of ecological civilization.I use the opportunity to practice,to the Qiandongnan intermediate people's Court on the basis of in-depth research in Qiandongnan,has made a wealth of information.In this paper,by using literature and statistical research,social investigation method and other research methods,analysis of the ecological environment in Qiandongnan,research crime has formed the basis and summary,is divided into six parts,which are: introduction;the first chapter: the basic theory of ecological environment crime;the second chapter: the research situation;the third chapter: analysis of the causes of the problems of Qiandongnan ecological environment crime;the fourth chapter: the prevention and punishment of environmental crimes;conclusion.In the introduction part,including the research background,the reasons for choosing the topic,the significance of the topic,research methods,this part is the basis of the following chapters.The first chapter is about the basic theory of the ecological environment crime,including the concept,characteristics,constitute the three part.The second chapter is the analysis of the ecological environment in Qiandongnan Prefecture of the crime data I research summary,is divided into two parts,the first part of the "Qiandongnan ecological environment crime situation and analysis of" the number of cases,including the types of cases,sentencing,subject,subjective aspect and objective aspect of five elements;the second part is "the analysis" the investigation of crime in Qiandongnan ecological environment investigation of typical cases,including analysis of the contents of two judges.The third chapter is the analysis of the causes of Qiandongnan's ecological environment crime,which is divided into three parts.The first part of the "social constraints" includes three aspects: economic development,economic interests and mass consciousness.The second part of "law enforcement constraints" includes three aspects of administrative examination and approval,and the Department in charge of law enforcement personnel;the third part of the "other factors" talked about the two aspects of sentencing and ecological environment protection legal system.The fourth chapter is I put on the prevention and punishment of environmental crimes,including strengthening ecological and environmental protection social function "and" norms of the relevant functional departments of law enforcement "to" increase the ecological and environmental crime crackdown "and" to improve the ecological environment protection legislation "in four parts.
