The recruiting system of civil servants "into" the mark,has important significance to improve the civil service integrity and work ability.In recent years,the civil service exam recruiting rising,attention of the infringement occurred in the process of recruiting has gradually attracted people,and our current way of relief in the field but there are still shortcomings,not to damage the interests of the candidate to provide the effective measures to protect the legitimate rights of the candidate.It is very important to the process of recruiting civil servants.The effective maintenance of the legitimate rights and interests of examinees,righteousness is the sound of recruiting civil servants to work,but also the maintenance Right of equality in the constitution of our citizens' right to appeal and accusation,need to know such rights as the reality.But due to the restriction of the objective social environment of our country,leading candidates of right relief were ignored,the academic research on this issue are mostly concentrated in the recruiting system itself level,the corresponding relief problem the right subjects lack sufficient attention.Legal proverb says: there must be a right of relief.Without effective relief,the legitimate rights of citizens will become a mere scrap of paper.Therefore,in order to safeguard the legitimate rights and interests of citizens in recruiting civil servants,while promoting the legal construction of our country reform and progress,we must improve the existing means of relief.With the protection of our citizens consciousness of rights gradually improve,whether it can provide effective relief measures to safeguard the legitimate rights and interests of citizens is the test of a country's legal status is the best scale good,to protect the rights of citizens in the process of recruiting civil servants is particularly important.This paper aims to study the current situation of rights in our country recruiting relief and defects of existing remedies the lack of reason,combined with China's specific national conditions and put forward the corresponding improvement suggestions,in the process of recruiting civil servants to provide theoretical reference for citizens to safeguard their legitimate rights and interests.The article is divided into four parts:The first part is the analysis of the properties and behavior of civil servants to remedy the right value.This part by law and the theory of two aspects of behavior of recruiting civil servants are analyzed and defined,of all kinds of power and the nature of the process of recruiting involved are summarized,and the significance and value of the right to relief this from the perspective of theory.The second part from the perspective of theory of administrative law described for recruiting civil servants in all kinds of power possible remedies,including litigation and non litigation relief in two categories,and combined with the relevant laws and regulations and the basic conditions of our country are analyzed briefly demonstrated.The third part is mainly aimed at a brief overview on the implementation of China's present situation and shortcomings of various ways of relief,and combined with the specific conditions and the rule of law in China made a brief analysis of the causes of defects,relief measures to lay the theoretical foundation for the fourth part puts forward the corresponding rights.The fourth part for our problems in recruiting civil servants in various relief ways and puts forward some suggestions.In this part,in addition to put forward some corresponding suggestions aiming at the defects of non litigation and litigation two remedy itself,but also from the current situation of our country's basic national conditions and the construction of rule of law in the legislation of the legal supervision and puts forward some improvement suggestions.
