Personal Data Security Legal Protection Research

With the Internet technology developing continuously which is marked by cloud storage and cloud computing,value hidden in the massive data is being tapped constantly,on the one hand,technology is as the role of social reformer,on the other hand,it breaks the social formation and thinking inertia.Technical progress lashes the hedge of ethic,moral and law,the passive factors are absorbed by social rules,and the negative factors always bring out new social problems and system gaps.We wonder at date taking the huge function on accurate prediction and the distribution of resources in the social supply and demand,however the social problems raised by data,most of all,the problem of personal data security is becoming the worry in daily life.Social evolution is always falling into the whirlpool of “innovation productivity” and “avoiding negative”,the corresponding system was born,in other words,it seems the marginal cost that technology innovation gives rise to social reform.One system is not a static or closed concept presetting,it changes constantly with the step of technology innovation and social reform.In fact,technical data application is always walking before the personal data security protection,there are two factors,the one is that the conscious of current personal data security protection is still bound to traditional type and can't adapt to the complexity and mutability of modern social formation;the other is that it may be conscious of the former mentioned,but system designing,strategy and performance lagging behind so much causes that personal data security protection departs from legislation and supervision.This paper is divided into five parts,the first part introduces the basic concept about personal data and personal data security;the second part analyzes the traditional personal data security theory and answer the necessity of legal protection of personal data security,for leading the system improving of personal data security to the new direction;the third part analyzes the problems and reasons of the current personal data security;the fourth part introduces the foreign experience and which could give inspiration to China;the last part tries to construct the regulatory path of personal data security protection.
