Under The Regional Environmental Protection, The Functions Of Local Government Agencies Are Fulfilled

Government agency has a long history,it is one of the effective and low cost way of divisional administration.It can strengthen the government control by centralization and decentralization.As well as promote economic growth.Environmental issue is even worsening due to the rugged economic develop in the past years,so environmental conservation is getting more attention.Currently China is outmoded in legislation of environmental law,there is few legal norm for government agencies,there is even less research on the environmental conservation function of the agencies.This paper takes Qinling Agency of Xi'an as example to study the environmental conservation function of government agencies and analysis the problems along with the implementation process,thus to push the agencies implement their function in the right place.This study has five parts.Part 1 is the introduction of the background,objectives and reviews of latest progress of this research worldwide.And also give basic knowledge about the research.The second part is focus in conceptual definition and theoretical basis.In the conceptual definition section,this paper clarify the function of local government and agencies and the relationship between environmental conservation and government,based on this,to give a brief introduction of public policy theory,public choice,public goods theory and organization theory.The third part is introduce the status of local government agencies under the circumstance of regional environmental conservation.This part starts with the basic introduction of northern Qinling(Xi'an section)and government agencies under the circumstance of regional environmental conservation,as well as the function position.The final conclusion is made based on the case studies which show some offside,misplacement and vacant of environmental conservation function among government agencies.The fourth part is analysis the existing problems and the reason of the government agencies in the process of environmental conservation.Based on the above studies result,this paper firstly analysis the reason for the offside of environmental conservation function among the agencies,for example,lack of legislative authority,undefined of the position and function of the agencies.Then the paper explores the misplacement of environmental conservation function of the agencies,such as function overlap,unclear of right and duty with local government.The final section of part 4 is about the vacant of the agencies on environmental conservation function,the reasons are mainly attribute to the incomplete of ecological protection management system,lack of law enforcement and special funds supervision systems.The fifth part is forwards the strategy of function fully coverage of the government agencies under the circumstance of regional environmental conservation.There are three suggestions come into conclusion.For the function offside,this paper suggests clearly function definition for all related departments and define the environment conservation function and obligations for Qinling area.Moreover,government agencies should implement the right function and receive comprehensive supervision.In order to resolve the misplacement of agencies during the environmental conservation process,this paper suggests combined supervision from local function departments and government authority,and reinforce legislation supervision of agencies activity.As for the problem of function vacant,the suggestion is to create law enforcement and supervision system and build qualified team,more finance support and special funds supervision systems are also essential.
