Research On Trade Union Representation

With the rapid development of globalization,economic and political development of trade unions at this stage has a great impact on the trade union movement is facing severe challenges.Under the impact of capital-led globalization,the whole international community has shown a strong capital and a weak labor pattern.The results of the work,the interests of the masses of workers are weakened,the trade unions facing enormous pressure,the overall environment of the international trade union movement is worried.With the development of economy,the value of labor force increases,the contradiction between labor and capital is more and more,and the corresponding law has no obvious change.In the past decade or so,China’s socio-political and economic environment has undergone dramatic changes.Some of the provisions of the law are strictly unable to meet the needs of real life.Based on the legal research on the representation of trade unions,this paper finds out the practical problems in the current trade union law of our country,draws lessons from the relevant experience of trade unions in developed countries,puts forward the feasible suggestions of confirming,exercising and protecting the union representation,On behalf of balancing the unequal status of both employers and employees,with a view to the future trade union law to provide a useful reference.The main innovation content of the article is based on the definition of the theoretical basis of the theory of trade union representation.In the past,there were few articles on the representation of trade unions,which did not elaborate on the functions of trade unions and the theory of trade union representation.Representation of trade unions means that the law confirms that the union is entitled or qualified to become a representative of the interests of its members or employees.The main theoretical basis is social contract theory,communitarianism,communicative behavior theory,social law theory.In this paper,the union representation and civil law on the agency,political science in the representation of the right to political representation in the democratic to supplement the theory of trade union representation.The most critical of the union’s representation is to be applied in practice,and the most critical is to pass the strict democratic election procedure when the representation is obtained.The elected representative can respond directly,promptly and accurately to the labor The needs of the people.This aspect can justdraw on the views of political representation.Finally,the author puts forward some legislative proposals and other supporting measures for the perfection of the trade union representation.
