Research On The Termination Mechanism Of Shanghai Petitions

Letters and visits,a particular institution of China,has played a significant role in the long history of our country.Citizens,legal persons or other organizations may give information,make suggestions or comments,lodge complaints to the people’s governments at all levels and the relevant departments of the people’s governments through letters,visits,E-mails,faxes,phone calls,and so on.However,some complainant showed repeated,excessive and unconventional behavior during the petition,which disturbed the public order of society and attempted to achieve his excessive demands.These unreasonable,repeated complaint behavior takes up too much public resources,cost a great deal of administrative organ manpower and energy to deal with.It is a challenging issue of the petition system today.Petition system has receiving mechanism,conduct mechanism,but it lacks a termination mechanism.This paper introduces the necessity and function of the termination mechanism of letters and visits,and illustrates Shanghai’s practical experience.The paper selects the empirical conclusion of the exploration and termination mechanism of Shanghai P district,introduces the work flow.It refers to the features of third-party participation,the process of the hearing procedure and the conclusion of the termination.It is intended to indicate that the termination mechanism is a rigorous and complicated verification procedure,and the decision of the multi-party demonstration is worked out by the prudent attitude,which is an effective innovation of social contradictions management,and effectively defuses a batch of historical cases.During the reform of the petition system,the termination mechanism should be taken seriously and affirmed.
