Petition Legal Reform Path Analysis

The Letters and Visits system is one kind of system design what has the Sinicism, and it is an important method for the people to exercise their democratic rights and protective their legal benefits and also an important way for our government to develop the socialist democracy, hear the people' opinions, suggestions, requests and accept supervisions from the public. The Letters and Visits system has a deep social basis and the ideology foundation. In the specific historical period, it has played an important role to maintain regime and society stably. Along with our country social reform, it is a key transformation period for our country now. Continuous rush of 'letters and visits' reflects the system has lagged behind the time and can not solve problems and adapt to the new situation. So it is necessary for us to improve it.This paper applies the methods of comparing analysis, historical analysis and value analysis. Based on the research of the social practice and the study of relative documents, the author believes that the existence of the Letters and Visits system is reasonable and legal. The effect of the system is influenced by both of the internal and external elements. So we must adjust the system to the political and judicial environment.The first part of this paper introduces the basic theories of the Letters and Visits system. The author applies the theory which is put forward by Black to the theory which explains the existence of the Letters and Visits system. The second part of the paper refers the problems of this system. The author tries to analyze the reasons to the problems from both of the internal and external aspects. The third part of the paper tries to discuss the methods of the reform. First the author introduces the three attitudes of the reform of the system and then points out that the direction of the reform is to put the Letters and Visits system into the rule of law. Finally the author projects a three-step plan to make the Letters and Visits system run under the supervision of the national people' congress.
