At present,the number of netizens using the Internet in China is more than half the total population,and the popularity of the Internet is getting higher and higher,indicating that China has entered the Internet era.With the rapid increase in the technology level,the ability to process,collect,and transfer data has become more advanced and sophisticated.The direct consequence is the leakages of personal information and the violations of personal rights.Therefore,the importance of cybersecurity has been valued by the public,and "personal information protection" has gradually entered the public views.This paper summarizes the challenges faced by today's personal information protection through the collation and analysis of a large number of documents,and conducts an in-depth analysis of various infringing acts and characteristics.In addition,this paper focuses on the just promulgated Network Security Law to systematically interpret the implementation of this law.The Network Security Law is a landmark legislation in the governance of cyber security in China.Compared with the fragmented relevant legal provisions in the past,the rules for the protection of personal information formulated by the Network Security Law are more systematic and comprehensive.This law not only enriches the content of citizens' personal information right,but also makes detailed and strict regulations on the responsibilities and obligations of network operators and other subjects to protect users' personal information,which has played a positive role in strengthening the protection of personal information on the Internet in China.However,in this law,there are still some shortcomings in the personal information protection rules.For example,there is no procedural system to balance public and private rights,and the rights of citizens to protect personal information lack corresponding protection measures,and partial protection principles lack operability.In this paper,five chapters are arranged to study the protection of personalinformation under the Network Security Law.The first chapter clarifies the background and significance of personal information protection,and reviews domestic and international researches on personal information protection;the second chapter elaborates the concept of personal information,and analyzes the effect of personal information protection by the Network Security Law aiming at the concerning personal information terms in this law;in the third chapter,the author first summarizes the specific ways and characteristics of the infringement of personal information right,and defines the subject and object of infringement,and analyzes the damage caused by infringement of personal information right to individuals,society,and the state;the fourth chapter firstly combines the content of the third chapter and interprets the protection clause of personal information in the Network Security Law,and then summarizes the improvements of the existing issues after the establishment of this law;in the fifth chapter,through indicating the reference inspiration of the excellent extraterritorial legislation,the author puts forward the insufficiency and improvement methods of personal information protection with respect to the Network Security Law in China.By comparing with the legislation on the personal information security in Europe,the United States,Japan,and Germany,according to the importance of the current law in our country to the personal information protection,the author proposes that special laws and related administrative regulations,i.e.,personal information protection law,should be established,resulting in forming a complete legal protection system to protect personal information.
