Research On The Protection Of The Rights And Interests Of The Subject Of Personal Information Under The Network Security Law

With the advent of network society,information has become an important resource.As the fulcrum of the construction of network society,individuals often suffer from the dilemma of unclear ownership,privacy disclosure and many other rights and interests.Therefore,how to protect the rights and interests of the subject of personal information has become the basic problem of the construction of network and information law.As the basic law,the network security law determines the basic framework of China's laws in the field of network and information.Facing the practical demands of the protection of the rights and interests of the subject of personal information in China,it has become a topic of research value to take the text of the "network security law" as the object,collect its construction logic and examine its shortcomings.Based on this,this paper firstly reviews the basic theory of the protection of the rights and interests of the subject of personal information,and constructs the theoretical basis for the following research.Secondly,with the personal information protection practice demands for reference,in the network security law the provisions of the personal information protection of the rights and interests of the main body of the review,found that the network security law on personal information collection,data classification lack exist in such aspects as protection system,familiar with big data to kill,industry organizations and civil society has not fully considerations such as value of mining;Thirdly,based on the fact that the protection of personal information rights and interests in the network society is empty at the same time,and that the western society has already gone through the initial stage of theprotection of personal information rights and interests,this paper examines the legislative practices of the European Union,the United States,Japan and the republic of Korea in the protection of personal information rights and interests and draws some enlightenment to China.Fourthly,facing the comprehensive appeal of the rule of law in the information trading market,integrating the previous studies,it proposed that the protection of the rights and interests of the subject of personal information in China should be based on the network security law,and a legal system of personal information protection that can be compatible with the traditional civil law system should be established.
