Research On The Legal Issues Of Grassland Protection In China

In recent years,the problem of environmental pollution in grasslands in China becomes worse.The effective protection of the grassland environment through the approach of law and the rational exploitation of grassland resources in our country are not only related to the sustainable development of grassland ecosystem in our country,but also have important practical significance for ensuring the economic development and social stability in our country.Based on the legal necessity of grassland protection,this study has investigated the current ecological status of grasslands and the legal system of the grassland protection in China,especially the main contents of the five major ongoing grassland protection law systems were analyzed,which are the basic grassland protection system,grass-animal balance system,and returning farmland to grassland,including the grazing ban,pastoral grazing system,grassland contracting system,and grassland legal responsibility system.Through its implementation,it is concluded that the main issues of China's grassland protection legal system are concentrated in the two parts of legislation and law enforcement.The existing problems in the legislation are:the legal system of grassland protection in China is not perfect,the system of grass and livestock balance is not perfect,and the legal responsibility system is not perfect.In law enforcement,there are problems that the connection between law enforcement and legislation is not in place,and the lack of supervision and dislocation.With reference to the grassland protection system of Mongolia and United States,which are worth learning from,it is suggest that,firstly,improve the legal system of the grassland protection;Improve the basic grassland protection system,grass-livestock balance system and grassland legal responsibility system;Secondly,improve the connection between law enforcement and legislation,strengthen the government's law enforcement supervision,and pay attention to the role of multi-party entities in administrative law enforcement.
