Since the third Plenary session of the 18 th CPC Central Committee made a resolution "allowing social capital to participate in urban infrastructure investment and operation by means of franchising and other means",The attention paid by all parties to the PPP model continues to rise.However,it is not easy to popularize the PPP model.There are many problems in the practice.The reason that the relevant PPP theory is not mature in our country,the unsound legal system is also the main obstacle.There is no uniform PPP legislation in our country.Therefore,the first step is improve the PPP model of the laws and regulations to develop the trend of our country.The legal regulation of the PPP model first introduces the basic meaning and the basic theory of the value analysis,and then analyzes the status and problems of the legislation and operation of the PPP model in our country,including the lack of legislative supply,the low level of the current PPP law and the unclear competence of the PPP competent authorities.Lack of unified regulatory bodies,unclear nature and legal relationship of PPP projects,imperfect PPP supporting mechanism,poor procedural rules and operation.According to the national conditions of our country,the countries with more sound laws and regulations of foreign PPP mode are studied and used for reference.Finally,the four aspects of perfecting the law of our country from the construction of the PPP model system legal system,the establishment of the national unified regulatory agency,the improvement of the dispute settlement mechanism and the establishment of the standard PPP mode supporting mechanism are put forward.Suggestions on regulation.
