On The Definition Of Public Interest In Urban Housing Collection

Countries in the world usually stipulate that urban housing expropriation needs the purpose of public interest.China's constitution and laws have also been made.Only when the public interest is needed,can the State levy expropriation on the lawful private property of citizens and enterprises.The current definition of the concept of public interest is still not clear,resulting in money,rent-seeking corruption is rampant,resulting in the destruction of the system of administrative law,in the process of collection for expropriation of public interests in the region are not clearly defined,and the public interests contradiction caused has become increasingly sharp.Therefore,it is particularly important to improve the research on the definition of public interest.This article starts from the definition of public interest in the collection of urban housing,and discusses it in three parts.The first part is the outline of the basic theory of public interest definition in urban housing levy,mainly expounds the basic concept of public interest,defines the meaning and legislative status of public interest at present stage,and studies the characteristics of public interest.The second part is the legal problems of the definition of public interest in the urban housing levy.It mainly analyzes and finds the problems and reasons in the six aspects of legislation,defining subjects,defining contents,defining standards,defining procedures and judicial remedies.The third part is the countermeasures to perfect the legal definition of public interest of the city housing levy,from the normative social phenomenon existing needs,to improve the city housing levy in the definition of public interest so as to put forward some feasible measures,in the legislative mode,set the stage of defining the subject of public interest,the entity content,defining standards,improve procedures and remedies mechanisms put forward in our country city housing levy in ways to improve the security of public interests.
