Reflections On The Collective Construction Land Transfer:A Case Study Of Haimen City

The country will continue to try to collective construction land transfer from the early 2000s.But the situation is still diversified and sundry.The transferability remained at the exploratory stage,yet there is no unified model.Collective construction land transferability is an important task of the current land reform.It is so important for breaking the urban and rural land use system,and establishing the new rural social security system,and promoting intensive use of land for construction,and Improving the socialist market economic system.Taken Haimen as example,and combined with the specific data,the things are analyzed such as circulation patterns,tax collection,distribution of income and pricing.By summarizing the experience and problems of collective construction land transfer in Haimen,look into the future of land transfer,and propose policy guidance for reference.The results show that,the main two forms of land transfer in Haimen are remise and leasing.There are few cases of assignment and mortgage,and no case of the price of shares.In the 10 years from 2002 to 2011,508 plots of land of 342.95 hectares are transferred,involving 261.06 million yuan in Haimen.The main achievements are establishing a more perfect system of transfer,and creating a scientific and rational income distribution,and improving the collective economic organizations and farmers' incomes,and remising the contradiction between supply and demand of land,and achieved the same price and the same transaction market with the state-owned land in the same place,and also promotes the intensive use of rural collective land.There are also some problems in transfer.The main problems are that policies are imperfect and there is lack of strong legal protection;resource allocation is not enough scientific,and the transfer is affected significantly by the policy change and human subjective factors;the subject in transfer is difficult to be define;homestead was not involved in the transfer in accordance with established plans and so on.In order to solve these problems,we must do something that unveil provincial laws,regulations and operating as soon as possible,and formulate the management method of land guarantee;clear the income subject and the mode of income distribution;reasonable charge related taxes,and reduce transfer costs;actively explore the feasibility and operational methods of collective land which is from agricultural land to non-agricultural land participation in the transfer.To break the bottleneck of current circulation in Haimen,we must explore the retransfer and exit mechanisms,and the distribution system of the land increment income and the homestead transfer.The purpose is to continue to provide a reference of transfer for the province and the country.
