| With the continuous acceleration of urbanization,the demand for urban construction land has surged.Rural construction land is largely idle.Some rural land resources are not used efficiently.The private transfer of rural land occurs from time to time and the interests of farmers and the state are greatly damaged.Problems such as low land use efficiency and low land use efficiency often occur.As one of the 33 pilot projects for rural land system reform in China,P District,with the joint efforts of governments at all levels,has fully utilized the government’s functions in planning,organizing,guiding,coordinating,and controlling.It has guided rural collective economic organizations to explore a feasible path for collective operating construction land to enter the market,successfully realizing the effective utilization of idle land resources and converting them into capital.The experience of the reform of rural collective operating construction land in P district has provided empirical evidence for the third revision of the Land Management Law.The revised Land Management Law was passed at the 12 th meeting of the Standing Committee of the 13 th National People’s Congress on August 26,2019.Through the methods of literature analysis,data analysis,investigation analysis and case analysis,this paper is supported by the theory of differential land rent,the theory of induced institutional change,the theory of modern property rights division,and the theory of general management,combined with the practice of government guidance in the market of P district.It mainly analyzes how the government performs the functions of planning,organizing,guiding,coordinating and supervising in the process of entering the market.According to the analysis,in the process of market entry of rural collective operational construction land under the guidance of the government,P District is faced with difficulties in the coordination of legal provisions and existing policies in terms of functions such as guidance and coordination,difficulties in the integration of scattered land into the market,lack of coordination between market entry and land acquisition,contradictions in income distribution,and obstacles in the path of power realization.On this basis,it is proposed to optimize the government guidance practices from the aspects of perfecting the system and policy system,optimizing the layout of territorial space,strengthening the coordinated promotion of reform,improving the income distribution system,opening up the financing mortgage channels,etc.,so as to take the lead in the market of rural collective commercial construction land,and provide help for the overall market of rural collective commercial construction land. |
